Children and Separation: Putting Stability First
When parents separate, children need stability, routine and reassurance. In this article we explain what children need most, how to reduce conflict around them, and how clear child arrangements can help everyone feel more secure.

Urgent Child Return & Contact Issues
You may need an emergency application if, for example:
• Your child has not been returned after an agreed contact visit
• Your child has been taken or kept without your consent
• There is a real risk of abduction
• There are serious concerns about abuse or neglect
If any of these apply, call us immediately for advice on the best urgent steps to take.
Family Law Emergency Orders are designed to protect children from immediate risk of harm. If you are concerned for your child’s safety, contact us as soon as possible so we can advise whether an urgent application should be made and which orders may be available to you.
An emergency application can be made and, if the Court agrees there are safeguarding risks, it can make urgent interim Orders before the usual Court process takes place. Orders can be made without notice (when the other side are not told about the first hearing). The Court will then list a review hearing where the other side can respond and challenge the application.
An emergency application can mean you need to attend Court on the same day you issue the application, and the Court may make an Order that day.
It is important to understand that the Court may have a different view from you about what is “urgent”. These applications should involve safeguarding concerns about a child such as, but not limited to:
• the child having suffered or being at risk of abuse (including physical or sexual abuse)
• neglect
• risk of abduction
• a child not being returned after contact.
If the other parent has simply stopped contact, the Court may not treat this as an emergency. In those cases, the usual process should be followed, including a referral to mediation.
Fixed Fee Clarity
Our fixed services for case consultations and the preparation of your application start from £1,500. Standard court fees remain payable separately.

Filing the Order
We manage the direct filing of your application with the Court, navigate the fees and support options with you, and offer professional guidance throughout the hearing process.
Step-by-Step Application Support
Navigating an urgent application can feel overwhelming, but we are here to support you at every stage. Typically, the process begins by completing a C100 form and, if there are specific safety worries, a C1A form. These documents allow you to concisely outline your concerns so the Court understands the immediate necessity of your request. Rest assured, you will have the opportunity to provide a more detailed statement later in the proceedings.
Financial transparency is also a priority. The current Court fee is £255, but you may be eligible for a reduction or complete waiver through the Court’s ‘Help with Fees’ scheme. We can help you assess your eligibility based on the official guidelines to ensure you aren't paying more than necessary.
Depending on the specific Court, applications are submitted either in person or via email. If we are representing you, we will handle this logistical filing; if you are self-representing, we recommend contacting the Court directly to confirm their preferred submission method. Once an Order is granted, it must be officially served to the other party to become legally binding. If the Order was made ‘without notice,’ it only takes effect once the Respondent is formally notified.
Please keep in mind that emergency Orders are interim measures designed to provide immediate protection while your case moves through the standard legal process. You will be expected to attend follow-up hearings and follow all Court directions. Reach out to us today for a reassuring conversation about how we can help secure your child’s safety.
